1. Agreement to Terms

By accessing or using BartsTees.com ("the Site"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Site.

2. Use of the Site

You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Site in any way that violates applicable law
• Attempt to gain unauthorized access to any part of the Site
• Use the Site to transmit harmful or malicious content
• Interfere with or disrupt the Site or its servers

3. Products and Orders

All products are print-on-demand and made to order. We reserve the right to refuse or cancel any order for any reason, including product availability, errors in pricing or product information, or suspected fraud.

Prices are listed in USD and are subject to change without notice. We are not responsible for typographical errors in pricing.

4. Payment

All payments are processed securely through Stripe. By placing an order, you represent that the payment information you provide is accurate and that you are authorized to use the payment method. You agree to pay all charges incurred under your account at the prices in effect when the charges are incurred.

5. Shipping and Delivery

Orders are fulfilled by our print-on-demand partner, Printful. Estimated production time is 2-5 business days, with shipping times varying by location. We are not responsible for delays caused by carriers or customs. Shipping costs are calculated at checkout.

6. Returns and Refunds

Because our products are made to order, we do not accept returns for buyer's remorse. However, if your item arrives damaged, defective, or incorrect, please contact us within 14 days of delivery at kyle@bartstees.com with photos of the issue. We will provide a replacement or refund at our discretion.

7. Intellectual Property

All content on this Site, including designs, text, graphics, logos, and images, is the property of Bart's Tees or its licensors and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works from any content on this Site without our written permission.

8. Limitation of Liability

To the fullest extent permitted by law, Bart's Tees shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or purchase of products. Our total liability shall not exceed the amount you paid for the product giving rise to the claim.

You agree to indemnify and hold harmless Bart's Tees and its owners, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Site or violation of these Terms.

10. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Harris County, Texas.
