1. Agreement to Terms

By accessing or using BartsTees.com (the "Site"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Site.

2. Use of the Site

You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Site in any way that violates applicable law
• Attempt to gain unauthorized access to any part of the Site
• Use the Site to transmit harmful or malicious content
• Interfere with or disrupt the Site or its servers

3. Products and Orders

All products are print-on-demand and made to order. We reserve the right to refuse or cancel any order for any reason, including product availability, errors in pricing or product information, or suspected fraud.

Prices are listed in USD and are subject to change without notice. We are not responsible for typographical errors in pricing.

4. Payment

Payments are processed securely through Shopify. By placing an order, you represent that the payment information you provide is accurate and that you are authorized to use the payment method. You agree to pay all charges incurred under your account at the prices in effect when the charges are incurred.

5. Shipping and Delivery

Orders are fulfilled by our print-on-demand partner, Printful. We currently ship within the United States. Estimated production time is 2-5 business days, and U.S. orders typically arrive within 3-7 business days after production. We are not responsible for delays caused by carriers. Shipping costs are calculated at checkout, and standard shipping is free on U.S. orders over $50.

6. Returns and Refunds

Returns are accepted within 14 days of delivery and are always free. Because our products are made to order, we do not accept change-of-mind returns, but we do cover damaged, defective, incorrect, or wrong-size items. Contact us within 14 days of delivery at support@bartstees.com with photos and your order number. Approved refunds are issued to the original payment method within 10 business days.

7. Intellectual Property

All content on the Site, including designs, text, graphics, logos, and images, is the property of Bart's Tees, Bartlett Labs, or their licensors and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works from Site content without our written permission.

8. Limitation of Liability

To the fullest extent permitted by law, Bart's Tees and Bartlett Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or purchase of products. Our total liability shall not exceed the amount you paid for the product giving rise to the claim.

9. Indemnification

You agree to indemnify and hold harmless Bart's Tees, Bartlett Labs, their owners, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Site or violation of these Terms.

10. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Harris County, Texas.

11. Changes to Terms

We reserve the right to update these Terms at any time. Changes will be posted on this page with a revised date. Your continued use of the Site after changes are posted constitutes acceptance of the new Terms.

12. SMS/Text Messaging Terms

Bartlett Labs DBA Bart's Tees may send text messages from Bart's Tees to customers who explicitly opt in through a consent checkbox on the Bart's Tees website or through recognized opt-in keywords such as START, SUBSCRIBE, or JOIN. Consent is not a condition of purchase.

By checking the SMS consent box or otherwise opting in, you agree to receive recurring automated marketing and informational text messages from Bartlett Labs DBA Bart's Tees at the mobile number provided. Messages may include order confirmations, order updates, shipping notifications, tracking links, support responses, product drops, promotions, and other marketing alerts. Message frequency varies. Message and data rates may apply.

Messages may contain embedded links to Bart's Tees pages such as order status pages, package tracking pages, support pages, or product pages. Our SMS program does not include lending or loan content and does not include age-gated content.

After opting in, you may receive a confirmation message such as: "Bartlett Labs DBA Bart's Tees: You are now opted-in to receive order updates, support messages, and occasional drop alerts. Msg & data rates may apply. Msg frequency varies. Reply HELP for help, STOP to cancel."

You may opt out at any time by replying with any recognized opt-out keyword, including OPTOUT, CANCEL, END, QUIT, UNSUBSCRIBE, REVOKE, STOP, STOPALL. After opting out, you may receive a confirmation message such as: "You have successfully been unsubscribed. You will not receive any more messages from this number. Reply START to resubscribe."

For help, reply HELP or INFO to any message, or contact support@bartstees.com. A help response may state: "Reply STOP to unsubscribe. Msg & data rates may apply."
